Last week, the American democratic senator Ron Wyden sent a letter (pdf) regarding ACTA (Anti Counterfeiting Trade Agreement) to Ron Kirk, the American Representative to trade. He asks him to bring more transparency on the contents of the treaty, currently in negotiation between the United States, Europe and a dozen other countries. Before asking him a dozen questions. For example on types of intellectual property covered by ACTA and their definition of "counterfeiting" . But also on legal instigations envisaged  to encourage the Internet providers to collaborate with the rightful claimants to dissuade the stocking or the transmission not allowed by equipment protected by the copyright  . In what the Офис of Ron Kirk to be  impatient to answer  .

As reminds of him the jurist Michael Geist, Ron Wyden is not the first American senator to wonder about ACTA. Last November, les had already written in this sense to the American Representative in trade. And before them, in 2008, the senators Stalemate Leahy and Arlen Specter.

The American Representative in Trade negotiates a trade agreement which could have serious and detrimental effects on Internet and on the fair employs. His name is Anti-Counterfeiting Trade Agreement, or ACTA. Unfortunately, I cannot say to you what there is indoors because it is always in negotiation and I did not sign non-disclosure agreed. [] the American Representative in Trade said to me that ACTA would not cement the current dispositions of Digital Millennium Copyright Act of dispositions which I would like to see changing, as the clause anti-bypass. And they said that ACTA will not ask the Internet providers to become  cops of the copyright  . This has air well, but many respectable erudite persons continue thinking that it will lead to a policy of calibrated quick-witted answer which would punish the forgers recidivists by cutting them Internet.

Then let me be very clear. I will oppose to any try, by the Congress or by trade agreement, to cut the access to Internet. If people pirate films or music, they must be punished. There are laws against this illegal activity. And I do not want that the downloading of the homage made by Corey Vidal to John Williams counts. Or Stephanie Lenz de Altoona (Pennsylvania) who downloaded a video of her 18-month-old son dancing on Prince, and had to bring an action to get repairing on her name after the home of discs accuses her of violation of copyright. It should not count.

At the time when Internet access is so key for the education of our children, and when numerical literacy tuition is so important for our economic future, I would detest that for errors of a person, or of a child, the rest of the family is punished. [] we should speak of the way of enlarging the numerical access of every family in America, not of taking it away from it how.

The Newspaper of the net questioned Pierre Berecz, president of the French registrar Indom, on its waitings for 2010. This last said to fear the  tries of takeover  and to want to see the purpose of  "dictatorships" . Starting with that of Google:

For what I wait of this year it is the end of dictatorships, even if I think to be disappointed. I think of one especially, that of Google, who becomes unbearable. People do not think more than by Google. If somebody starts to sell screwdrivers, he is going to create Jevendsdestournevis.com, only to be classified well in Google, it doesn't much matter if the name is ridiculous and lacks creativity completely. Worse, today, most sites edit contents according to what is going to go back up or not in Google. Everything is calculated according to the reference in a commercial interest. But Internet was not created for this. In information, it is dangerous that this media of aggregation that is Google becomes more powerful than classical media. Everything crosses from now on by prism of Google. It is a brake in the multiplicity of information on Internet.

The report Zelnik (pdf), delayed to the Ministry of Culture last Friday, offers in the short term  to adopt a law taking back the fixed principles, for the physical book, by law on the unique price of 1981 by adapting them to the specificity of e-books homoth tiques  . That is to say apply the principle of law Lang to the unique price of the "paper" book  to the e-book.

The minister of Culture, Frederick Mitterrand, expressed himself yesterday, in The World, regarding the report Tessier (pdf) about the numeration of written heritage.

He multiplies attacks there against Google:  Google entered Europe by winning and many opened him the door by signing agreements which I think unacceptable. They are based on an excessive confidentiality, impossible exclusive rights, offhand clauses, or even leonine with regard to the copyright.  . While explaining that, according to him,  Google realises it and, already, I find the confident and less conquering firm in its communication  . And by playing the card, at the same time, of:  I do not feel like crossing me of Google  .

On Monday, The small museum of marks was learnt via Frederick Glaize of the site that mark Hadopi had been deposited by the French State in INPI (National Institute of Intellectual Property) on November 16th, 2009. This last gave another information which we had then put aside: the registered trademark by the Ministry of Culture is posterior in the mark Hadopi deposited on May 19th, 2009 by an individual, some Renaud Veeckman.

Questioned yesterday evening by the AFP this last explains to want to take up a deck of music downloading under this name.  I have never thought that the State would deposit mark  , point out t-il, while specifying not have been contacted, for the moment, by the government. Allowing to have wanted to use term Hadopi  " in an impudent, squared way " , he comments:  I am not an anti-Hadopi but I consider that this device is completely archaic in the way it was conceived and that he does not answer the remuneration of the artists  .

If both requests were published in the official Newsletter of industrial property (BOPI), and deposited in INPI, no was recorded this day. During store, INPI proves some criteria of bottom and in form, but not the availability of mark. And open then one delay of objection. Then, normally after one or two months mark is recorded, unless there is something that sticks in the file. What is case here, as confirmed it to us INPI. Last July, the Authority of competition returned its opinion on the exclusive rights of access to contents televised by providers with Internet (FAI). Notably that of Orange via its chains Orange Sport (6 a month) and Orange Cin ma S ries (12 a month). She estimated while  by purchasing of contents premium and by reserving them for his only Internet subscribers, the strategy of Orange includes the risk of destabilising the market of the high debit to the detriment of the rival operators  .

To supplement this opinion, the prime minister, Fran ois Fillon entrusted a mission to Marie-Dominique Hagelsteen, whose report,  The exclusive rights of distribution and of transport in the sector of paid television  , was delayed yesterday.

It is notably possible to read there that  the strategy of Orange includes number of disadvantages, in court, medium and long terms, which do not return its desirable maintaining  . Among these disadvantages, the report points out that  this form of exclusive rights, which reduces the fluidity of the market of broadcasting contents, can also constitute an additional instigation to illegal downloading or to pirate visionnage of programmes (by technique of streaming ), which is the only means at the disposition of the subscribers of other FAI to achieve programmes broadcast on the bunches of Orange  .

In conclusion the report thinks that it is therefore  not desirable that Orange continues in this strategy which, [] for the consumer, divides up exceedingly the access to contents and for the development of the market of the top and of very high debit, include competitive risks  . And to offer to put the exclusive rights of transport and of access under the supervision of a sectoral authority who would assure a  treatment case by case of exclusive rights  .

For mission this choice implicates necessarily the intervention of a law. Because he  creates an obligation payable by private individuals  , because  missions and competences of the independent administrative authorities talks about it, because it is about the Authority of competition, about ARCEP or about CSA are defined by the legislator  , and because the device should  be matched of a sanction to be real and because celle ci am not possible, here, be envisaged by regulation power  .

Jean-Fran ois Porchez, creator of the typograph y " Bienvenue " brought us new elements in history. For recall, this cast iron is illegally used in the original version of the logo of Hadopi introduced last Friday by the Ministry of Culture. Continuation, according to the society Creative Plan which accomplished him, in an error of computer manipulation

Concerning the "Welcome" , he confirmed us first of all:  it is an exclusive character rights of which I share with Telecommunications France  . And to inform us that the law firm is going to contact Telecommunications France and the Ministry of Culture  for illicit usage  of character. Of as much, as underlines it , as the logo was deposited in INPI (National Institute of Intellectual Property) on November 16th, 2009. Contacted by our care, these last specify us that a mark cannot be changed:  to avoid litigation, store must be abolished and it is necessary to make a new  .

Then it returns us to the pdf, sent by the society Creative Plan some hours ago, and packaging  the final identity kept by Hadopi  . Let be the new logo of Hadopi. He points out to us that, under the logo, it is pointed out the name of both used typographies. Let be the  SFR Lola  for "Hadopi" (coming so to replace the "Welcome" ) and "Bliss" , for  High authority for the broadcasting of writings and the protection of rights on Internet  , who was already used in the original logo.

And to point us out that the licences of this two cast iron were acquired by the society Creative Plan. this morning.

The version of Bliss was created by Jeremy Tankard. This last pointed out to have been contacted this same morning by Creative Plan to acquire rights. Idem on the side of " SFr Lola  . His creator, English Jason Smith brought back to Jean-Fran ois Porchez that character had been bought this morning.

Contacted again and again, the representatives for the society Creative Plan, which accomplished the logo of Hadopi, remained injoignables all morning long. To say finally that they would communicate only by mail.

It is therefore by mail that we received the following message: Following an error of computer manipulation, a draught of logotype which had been moved aside during the traditional stages of check on similarity, was inopportunely introduced as final graphic solution. .

Before adding:  This error has just been repaired and you will find enclosed the final identity kept by Hadopi . And to send, in reached room, the new logo therefore without "similarity" .

For recall, in obviousness, the typography of the original logo uses the  "Welcome" cast iron,  created in 2000 by Jean-Fran ois Porchez, in association with Landor Associates, for the support of communication of Telecommunications France.

And yet as reminds us of it a typographer, in the French frame, two types of cast iron are differentiated by contract. Those said commercial, an agency of design of which can acquire rights. And then use it to compose logos and to sell retail them to whoever. Then those accomplished for a society with a contract of exclusive rights, who are then subjected to the code of intellectual property. On the site of the Foundry Porchez, it is possible to read regarding the "Welcome" :  It is an exclusive character of Telecommunications France that will be never broadcast to the public  . What classifies this last, indeed, in the second category.

By using it cast iron for the logo of Hadopi, the society Creative Plan made two offences:
- the typography not being broadcast, it implicates that it was got in an illicit way
- the typography was used for realisation and sale of a logo

No reaction for the moment on the side of the Ministry of Culture, which prefers returning us towards the society Creative Plan.

In the meantime as underlines it PC INPACT, the file pdf relating to the installation of Hadopi, and introducing this logo, was withdrawn from the site of the ministry.

Until January 15th, very good and original game Pencil Physics Deluxe is available at the price which you want. Having accomplished by Petri Purho (Kloonigames), a Finnish student of 25 years, and victor of Independant Games Festival of 2008, game consists in drawing forms (lines, squares, circles, etc.) to bring a bullet, according to the laws of physics, towards a star.
