[EXPRESS]:  Internet is not a place

Master Eolas has been the guest of one on the site of the New Observer today. He spoke to it anonymity, ACTA, Hadopi, numerical identity, defamation, cryptography, etc.

Extracts:

International conventions are the only means to bring in the Internet a true regulation, by removing the legal problems of borders, which does not exist on Internet. But to bring to the same way of thinking on this regulation the EU, the United States on the one hand, and China and Iran of other one promises difficulties. Having said that, it is under way. This is called ACTA.

The Internet is not a place. It is a communications network. Right does not apply to it more than in your telephone. He applies on the other hand to those who are at the end of every cable: you, your h bergeur, your provider, etc. Who they are in the physical world. (..) Internet is not a place. Neither you or I are on Internet. I am in the places of Nouvel Obs, you are to your Офис or at home. We communicate by this tool, we do not meet there.  Nous communiquons par cet outil, nous ne nous y retrouvons pas.

I use every day software of cryptography to share documents covered by professional confidentiality with clients or associates. An e mail is also confidential as a postcard. Attention to this tendency to think that what they want to hide is willy-nilly suspicious. If curtains on the windows of his living room are hung, it is not to assassinate his wife with complete impunity.

Internet does not undermine in itself, in whatever it is. It is the user the representative. The one that is going learnedly to explain that Untel is guilty in three pillars of bar of Balto can say it from now on to hundreds of persons about a forum. Is it the error of the forum?

November 27th of this year, the New deputy centres Jean-Christophe Lagarde deposited one
bill  anti-Google Street View  .

In account, he explains:  If the views of " Yellow Pages cannot be extremely itemised, those of service Street View from Google gives such precision of the picture of the persons or of vehicles being on the street at the time of shot as they raise the problem of the respect for the right to the protection of private life. This problem risks, besides, deteriorating since since August, 2009, Google acquired three-wheelers equipped with cameras and capable of circulating and of photographing either only the visible parts since the street but also the inside of not visible properties by the passers-by. So, risks of attack in the protection of personal data and in that relating to private life are reduced.

Today, EuroISPA, association regrouping 1700 European Internet providers, published a press release in which she claimed to be concerned by opaque agreements of ACTA.  To measures if extreme would create an undermining serious danger and limiting the innovative space which is in the heart of the success of Internet  , declared Malcolm Hutty, president of EuroISPA.  This agreement would have a negative impact on the users of Internet without having a significant impact in the struggle against the illicit usage of protected equipment.

[EXPRESS]  The right to the picture must give in in front of the freedom of expression

A woman, who saw herself in photograph in a book called  Lose the head  by Fran ois - Mary Banier, allocated the editor on the foundation of articles 9 (right to the respect for private life) and 1382 (extra-contractual civil liability) of the Civil code. Nonsuited by the Higher level court, she called. On November 5th, 2008, the Court of appeal of Paris then pronounced a stopping which makes prevail over the principle of freedom of expression, tells on its blog Jo lle Verbrugge.

He considers that those who create, interpret, broadcast or display a work of art contribute to the exchange of ideas and of opinion necessary to a democratic society before noticing that the right to the picture must give in in front of the freedom of expression each time the exercise of the first would have the effect of standing in the way arbitrarily of freedom to accept or to announce ideas which express themselves especially in the job of an artist, safe in the case of a publication opposite to the dignity of the person or dressing for her consequences of a particular gravity

[Express]: The German president blocks law against the p do-pornography on Internet

The German president, Horst K hler, refused to sign for the moment the law which aims at filtering the childish pornography on Internet. Approved by the Bundestag in June, she initially had to come into force to the aout 1st. Horst K hle wishes  additional information " on behalf of the government, brought back on Saturday Der Spiegel, last Saturday. And it is after valuation that he will if yes decide or not to sign it.

The text, close to French plan Lopsi, makes the Internet providers block a list of sites worked out by the federal Service of criminal police (BKA). Defended by the minister of the family Ursula von Der Leyen, law was adopted June 18th of this year, in 389 votes against 128, by both rooms of the Parliament under the previous  big governmental alliance  . And it in spite of a strong opposition of the population. Today, the new alliance (CDU and FDP) issues doubts on the constitutionality of the text.

Many jurists consider law on the blockage of Internet unconstitutional  , brings back Der Spiegel.  Even the policies of right of the new coalition government, such as Max Stadler (FDP), think that he is incompatible with Constitution  .

[Express] to Filter fraud

Every supplier in an American Internet access will be able to be legally responsible for contents with fraudulent character, and for their possible consequences, if a bill, the Investor Protection Act (Law of protection of the investors), is adopted.

The text, vague, envisages that FAI is responsible if, once informed about forged contents, he did not intervene fast to prevent access from it and to block it. Notion of fraudulent, or usurpatory, is broad and covers as well the phishing, the scam, the usurpation of identity, private data or of mark, etc. Also, it concerns pages not only web, but also of e-mails, dialogues by VOIP, etc. Also, Declan Mc Cullagh of French telecommunications research centre wonders if sanctions towards FAI will be applicable even if filtration is not technically accomplishable. Either if this requirement of blockage will apply to the employers of the private sector, to the schools and university, or to the coffees offering a wi-fi access.

[Express]  Brice, or the convolution of the net by an e-gnare

Its solution it is therefore filtration, it is going to block the access to some sites, without defining borders with it too much (just to be capable of filtering everything a bit and anything). It is any beginning of the convolution of the net by the e-gnare. When the e-gnare makes a decision, he puts a point of honour not to be tried to include the effect of chain which he is going to procreate. It takes refuge behind the State of Right (except that Internet it is not really a State and that right exists, free to Brice to give to competent services the means to apply him). Suddenly, as the e-gnare does not like to include, he would really like that become everything vague with the eyes of those for whom everything is perfectly clear ( )

And here is our Brice who leaves in war with his spear stone at the hand and its strainer on the head. Some people call this of political courage, Sun Tzu, in the Art of war, calls this of the suicide. Brice's spear-stone is called Loppsi, its strainer is called the filtration of the net.
